SWMP Regulations
On 15th February 2008 the Site Waste Management Plans Regulations 2008 (the Regulations) were laid before parliament. They came into force on 6th April 2008 although projects planned before this date do not require a SWMP provided that construction begins before 1st July 2008.
There is not legal requirement for a project of contract value greater than £300,000 but undertaken over multiple sites (clearly geographically separate) to undertake a SWMP although the client/contractor may decide that is in their interest to do so.
Exclusions
The SWMP regulations do not apply to construction works taking place at a Part A installation under the Environmental Permitting Regulations 2007 since these sites must already meet pollution prevention measures that include waste minimisation.
Where a nuclear licensed site has an Integrated Waste Strategy (IWS) in place that includes waste from construction activities, a separate SWMP is not required, provided that all the obligations set out in the SWMP Regulations are included in the Strategy and its supporting documents.
